Her iki birlikte Ipotek yapısı da paylı ve toplu Ipotek olmak üzere ikili bir alt gruplandırmayla ele alınmaktadır. TMK m. 855'e bakıldığında, biriikte taşınmaz Ipoteğinin toplu Ipotek ayağında ciddi sınırlamaların yapıldığıve bu birlikte Ipotek yapısına Istisnal olarak yer verildlği görülürken, TTK m. 1021'in birlikte gemi Ipoteği bakımından böyle bir kısıtlamaya gitmediği görülmektedir. Diğer taraftan bu İkl yapının birbirlerine ciddi anlamda benzeyen yönleri de mevcut bulunmaktadır. Codes. Both of these legal Institutions are divided Into two subcategories In themselves: Collective mortgage and partial mortgage. Under TCivIIC. Art. 855, though no restriction is foreseen for the establishment of partial mortgages, collective mortgages on real estates are only allowed under some exceptional and strict conditions. However, TComC. m. 1021 has a far more relaxed regulatory approach particularly for collective mortgages on ships, stipulating no restriction at all for the establishment of these. Despite the sald differences, these two Institutions share numerous easlly remarkable simllarities.
